Welcome to RecruitNav. These Terms of Use ("Terms") govern your access to and use of RecruitNav, including our website, software, features, tools, content, and related services (collectively, "RecruitNav").
RecruitNav is operated by Tartan Arch Digital, LLC ("Tartan Arch Digital," "we," "us," or "our"). By accessing or using RecruitNav, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, do not use RecruitNav.
RecruitNav is an educational decision-support platform designed to help users research, discover, evaluate, compare, and organize information about colleges and educational opportunities.
RecruitNav may provide personalized college matches, Match Scores, admissions outlooks or estimates, explanations, comparisons, school information, cost-related information, saved searches, saved schools, and other tools based on information supplied by users and information obtained or derived from third-party sources.
RecruitNav is intended to help users explore options and make more informed decisions. It does not make admissions decisions and does not replace information or advice from colleges, financial-aid offices, counselors, educational professionals, or other appropriate sources.
You must be at least 13 years old to create a RecruitNav account or use account-based features.
If you are under 18, you may use RecruitNav only if your use is permitted under applicable law and these Terms. Parents, guardians, and other eligible users may also use RecruitNav to research colleges or educational opportunities.
RecruitNav does not verify that an account holder is the prospective student whose educational options are being researched.
Children under 13 may not create a RecruitNav account or use RecruitNav's account-based features.
Some RecruitNav features may be available without an account. Other features require registration.
You agree to provide accurate account information and to maintain the security of your account credentials. You are responsible for activity occurring through your account except to the extent caused by our failure to use reasonable security measures.
You may not access another person's account without authorization or attempt to obtain another user's nonpublic information.
We may require email confirmation or other reasonable account-security measures.
RecruitNav results are informational and decision-support tools.
Match Scores, admissions outlooks or estimates, recommendations, explanations, comparisons, cost information, ranking-related information, prestige information, and other RecruitNav outputs do not guarantee:
• admission to any institution; • denial or acceptance outcomes; • financial aid or scholarships; • affordability or actual cost; • the availability or quality of any academic program; • that any particular institution is appropriate for you; • the accuracy or completeness of third-party information; or • any educational, financial, career, or other outcome.
RecruitNav may use estimates, models, incomplete information, user-provided preferences, and data that changes over time. Results should be considered alongside other reliable information and your own circumstances and judgment.
You are responsible for independently verifying information that may materially affect an educational decision.
Before relying on important information, you should confirm it with the applicable institution or authoritative source, particularly information concerning:
• admissions requirements and policies; • application deadlines; • tuition, fees, and cost of attendance; • financial aid and scholarships; • academic programs and majors; • accreditation; • enrollment or institutional characteristics; and • other consequential facts.
Do not rely on RecruitNav as the sole source for a consequential educational or financial decision.
RecruitNav may display, summarize, analyze, link to, or otherwise use information originating from colleges and universities, government sources, publishers, ranking organizations, data providers, and other third parties.
Third-party information may be incomplete, delayed, inaccurate, unavailable, or changed by its source after RecruitNav obtains or displays it.
References to third-party institutions, rankings, trademarks, logos, publications, data, or services do not imply ownership by or endorsement of RecruitNav unless expressly stated.
Third-party trademarks, content, data, and other intellectual-property rights remain the property of their respective owners and are subject to applicable rights, licenses, restrictions, and terms.
Links to third-party websites or services are provided for convenience or informational purposes. We do not control those third parties and are not responsible for their content, availability, security, or practices.
You may provide information to RecruitNav through questionnaires, preferences, saved searches, saved schools, feedback, account information, and other features.
As between you and RecruitNav, you retain any rights you have in information you provide.
You give Tartan Arch Digital a limited right to host, store, process, analyze, reproduce, and otherwise use that information as reasonably necessary to:
• provide RecruitNav to you; • maintain your account and saved information; • personalize RecruitNav; • operate and secure the service; • troubleshoot and improve RecruitNav; and • perform other activities described in our Privacy Policy.
This permission does not transfer ownership of your personal information to Tartan Arch Digital.
Our collection, use, retention, and deletion of personal information are also governed by our Privacy Policy.
You may use RecruitNav only for lawful purposes and in accordance with these Terms.
You may not:
• access or attempt to access another user's account or nonpublic data without authorization; • interfere with or disrupt RecruitNav or its infrastructure; • bypass or attempt to bypass security, access, rate-limit, or technical controls; • probe, scan, or test vulnerabilities without written authorization; • reverse engineer or attempt to extract nonpublic source code, proprietary scoring logic, confidential models, or trade secrets except to the extent such restriction is prohibited by law; • use bots, crawlers, scrapers, automated extraction tools, or similar systems to access or collect RecruitNav content or data at scale without our written permission; • copy, reproduce, distribute, or commercially exploit RecruitNav or its proprietary content except as expressly permitted; • introduce malicious code or harmful material; • impersonate another person or misrepresent your authorization to access an account; or • use RecruitNav in violation of applicable law or the rights of another person.
We may investigate suspected misuse and may restrict, suspend, or terminate access when reasonably necessary to protect RecruitNav, our users, our rights, third parties, or the security and integrity of the service.
RecruitNav and its proprietary software, interfaces, designs, original content, branding, documentation, methodologies, compilations, and other protectable materials are owned by or licensed to Tartan Arch Digital and are protected by applicable intellectual-property laws.
The RECRUITNAV name and associated branding are proprietary brand assets. Nothing in these Terms grants you ownership of RecruitNav intellectual property.
Subject to these Terms, Tartan Arch Digital grants you a limited, personal, nonexclusive, nontransferable, revocable right to access and use RecruitNav for its intended purposes.
This section does not claim ownership of third-party information, trademarks, public-domain materials, government data, or other third-party rights displayed or used through RecruitNav.
If you voluntarily provide suggestions, ideas, comments, feature requests, or other feedback concerning RecruitNav, you agree that Tartan Arch Digital may use that feedback without restriction or compensation to you.
Providing feedback does not give you ownership of any product, feature, improvement, or other work developed using or inspired by that feedback.
RecruitNav is evolving and may be offered as a beta or developing service.
We may add, modify, suspend, or discontinue features or portions of RecruitNav. We do not guarantee that RecruitNav or any particular feature will always be available, uninterrupted, secure, or error-free.
We may correct errors, update information, change data sources, modify technical systems, or make other changes as RecruitNav develops.
Where reasonably appropriate, we may provide notice of material changes affecting registered users.
RecruitNav currently may offer features without charge.
We may offer paid products, features, services, or specialized experiences in the future. If we do, applicable pricing, payment terms, renewal terms, refund terms, or additional conditions will be disclosed before a user purchases or subscribes to the applicable offering.
These Terms do not require you to purchase any future paid offering.
You may stop using RecruitNav at any time and may use available account-deletion functionality where provided.
We may suspend or terminate access to RecruitNav if we reasonably believe that you have violated these Terms, created a security or legal risk, misused the service, or engaged in conduct that may harm RecruitNav, another user, or a third party.
Where reasonable under the circumstances, we may provide notice before termination. Immediate action may be taken when necessary to address security, fraud, unlawful activity, abuse, or other material risk.
Provisions that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, disclaimers, limitations of liability, feedback, and disputes.
TO THE FULLEST EXTENT PERMITTED BY LAW, RECRUITNAV IS PROVIDED "AS IS" AND "AS AVAILABLE."
TARTAN ARCH DIGITAL DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.
WE DO NOT WARRANT THAT RECRUITNAV WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT INFORMATION OR RESULTS PROVIDED THROUGH RECRUITNAV WILL ALWAYS BE ACCURATE, COMPLETE, OR CURRENT.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
TO THE FULLEST EXTENT PERMITTED BY LAW, TARTAN ARCH DIGITAL, ITS AFFILIATES, AND THEIR RESPECTIVE MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO RECRUITNAV OR THESE TERMS.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF TARTAN ARCH DIGITAL AND THE FOREGOING PARTIES FOR CLAIMS ARISING OUT OF OR RELATING TO RECRUITNAV OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TARTAN ARCH DIGITAL FOR RECRUITNAV DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.
These limitations apply regardless of the theory of liability and even if a remedy fails of its essential purpose, except where applicable law does not permit the limitation.
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Tartan Arch Digital, its affiliates, and their respective members, officers, employees, and agents from third-party claims, liabilities, damages, losses, and reasonable costs arising from:
• your unlawful use of RecruitNav; • your material violation of these Terms; or • your infringement or violation of another person's rights.
This section does not require you to indemnify a party for that party's own fraud, gross negligence, willful misconduct, or other liability that cannot lawfully be shifted to you.
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles.
To the extent a dispute arising out of or relating to RecruitNav or these Terms is brought in court, you and Tartan Arch Digital agree to the exclusive jurisdiction and venue of the state and federal courts located in North Carolina, except where applicable law requires otherwise.
We may update these Terms from time to time as RecruitNav changes or as legal, regulatory, operational, or business requirements evolve.
If we make material changes, we may provide notice through RecruitNav, by email, or by other reasonable means. The updated Terms will state their effective date.
Your continued use of RecruitNav after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
These Terms, together with the Privacy Policy and any additional terms expressly applicable to a particular RecruitNav feature or service, constitute the agreement between you and Tartan Arch Digital concerning your use of RecruitNav.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the maximum extent permitted by law.
Our failure to enforce a provision of these Terms is not a waiver of that provision or any other right.
You may not assign your rights or obligations under these Terms without our consent. Tartan Arch Digital may assign these Terms in connection with a merger, reorganization, sale of assets, corporate restructuring, or other lawful transfer of the RecruitNav business.
